Le Plan ontarien de lutte contre la pand\u00e9mie de grippe stipule qu\u2019un travailleur de la sant\u00e9 a le devoir moral de fournir des soins et d\u2019intervenir en cas de souffrances. (POLPG, 2008) Le document <em>Stand on Guard for Thee<\/em> de 2005 du Joint Centre for Bioethics de l\u2019Universit\u00e9 de Toronto r\u00e9it\u00e8re le devoir moral qu\u2019ont les professionnels de la sant\u00e9 envers la population. Une th\u00e9rapeute respiratoire qui travaille aux urgences d\u2019un important h\u00f4pital universitaire est la m\u00e8re monoparentale d\u2019un enfant qui va \u00e0 une de ces garderies. L\u2019h\u00f4pital conna\u00eet une augmentation importante du nombre de visites au service des urgences et plusieurs th\u00e9rapeutes respiratoires sont d\u00e9j\u00e0 malades. On ne sait pas de fa\u00e7on claire si son absence du travail affecterait les soins offerts aux patients ou clients (d\u2019autres employ\u00e9s peuvent offrir ces m\u00eames soins). Toutefois, si elle ne peut trouver un autre moyen de faire garder son enfant, elle ne peut, de fa\u00e7on morale ou l\u00e9gale, laisser son enfant seul. De plus, ce refus de services pourrait mettre en danger la vie, la sant\u00e9 ou la s\u00e9curit\u00e9 de ces patients. Par cons\u00e9quent, dans cette situation, la th\u00e9rapeute respiratoire est tenue de respecter les exigences de son emploi.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Parfois, des obligations multiples peuvent causer des conflits de priorit\u00e9s qui sont vraiment diff\u00e9rents d\u2019une personne \u00e0 l\u2019autre. Par cons\u00e9quent, chaque th\u00e9rapeute respiratoire doit s\u2019assurer d\u2019\u00e9quilibrer sa propre situation et l\u2019int\u00e9r\u00eat v\u00e9ritable de ses patients ou clients. En situation de conflit entre diff\u00e9rents devoirs, l\u2019Ordre s\u2019attend \u00e0 ce que les membres s\u2019efforceront du mieux de leurs capacit\u00e9s de fournir des soins moraux, s\u00fbrs et comp\u00e9tents aux patients ou clients.<\/span><\/p>\n<p>[\/et_pb_accordion_item][\/et_pb_accordion][et_pb_text admin_label=\u00a0\u00bbPerformance Expectations\u00a0\u00bb _builder_version=\u00a0\u00bb4.8.2&Prime; custom_margin=\u00a0\u00bb||-3px|||\u00a0\u00bb custom_padding=\u00a0\u00bb0px|||\u00a0\u00bb]<\/p>\n<p>L\u2019article 43(1) de la <em>Loi sur la sant\u00e9 et la s\u00e9curit\u00e9 au travail<\/em> d\u00e9crit dans quelles circonstances certains types d\u2019employ\u00e9s peuvent refuser le travail par crainte d\u2019\u00eatre expos\u00e9s \u00e0 un risque.
